Jiya Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Jiya iOS application and related services (the “Services”), provided by Web and Things, LLC (“Jiya,” “we,” “us,” or “our”).
By creating an account or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or 16 if you reside in the European Economic Area or United Kingdom) to use the Services. By using Jiya, you represent that you meet these age requirements and have the legal capacity to enter into these Terms in your jurisdiction.
If you are using the Services on behalf of a minor (e.g., a family-account scenario), you represent that you have legal authority to do so and you accept these Terms on the minor's behalf.
2. Your account
2.1 Creating an account
You can create an account using Sign in with Apple or email + one-time code. You are responsible for keeping your account secure and for all activity that occurs under it.
2.2 Accurate information
You agree to provide accurate, current, and complete information in your profile (display name, username, etc.) and to keep it updated.
2.3 One person, one account
You may not impersonate any person, misrepresent your identity, or operate multiple accounts to circumvent any feature, restriction, or competition outcome.
3. The Services in plain language
Jiya lets you create or join short-running fitness competitions with friends. Your activity is read from Apple Health on your device and aggregated for competition leaderboards. At the end of a competition, an AI-generated cartoon recap image is created.
You acknowledge that:
- Apple Health is the source of truth. We display the values your device's Apple Health reports. We do not independently verify the accuracy of those readings.
- Connectivity matters. Real-time leaderboards require a working internet connection. Outages may delay synchronization.
- AI image generation is best-effort. Recaps are produced by a third-party model (OpenAI's gpt-image-1) and may not perfectly resemble participants. The output is provided “as-is.”
- The Services are for entertainment and fitness motivation only — not medical advice. Consult a qualified professional before starting any new exercise regime.
4. Acceptable use
You agree not to:
- Use the Services in violation of any applicable law, regulation, or third-party right.
- Submit content that is unlawful, abusive, harassing, defamatory, hateful, sexually explicit, or that infringes intellectual-property or privacy rights.
- Upload a profile photo of any person other than yourself, or any photo for which you do not have full rights.
- Use the Services to harass, threaten, stalk, or impersonate any person.
- Attempt to artificially inflate your activity metrics through any means other than legitimate physical movement read by Apple Health (e.g., shaking your phone or rigging the device to register false steps).
- Interfere with, probe, scan, or test the vulnerability of the Services or related infrastructure.
- Reverse-engineer, decompile, or attempt to extract source code or trained model weights.
- Use any automated means (bots, scrapers, etc.) to access or interact with the Services.
- Resell, sublicense, or commercially exploit any portion of the Services without our prior written consent.
We may suspend or terminate your account at any time for conduct we reasonably believe violates these Terms.
5. Content and licenses
5.1 Your content
You retain ownership of the content you submit to the Services (profile photo, display name, bio, competition names, reactions, and quick-phrase messages — collectively, “Your Content”).
By submitting Your Content, you grant Jiya a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, modify (e.g., resize, recompress, crop, transcode), and create derivative works (e.g., the AI cartoon recap) of Your Content, solely to the extent necessary to operate, provide, secure, and improve the Services. This license ends when you delete the relevant content from your account, except for back-ups retained for the period described in our Privacy Policy and any copies already shared with other users.
You represent that:
- You own or have the necessary rights to submit Your Content.
- Your Content does not violate any third-party rights or applicable laws.
5.2 AI recap images
The AI cartoon recap image generated for each competition is produced by a third-party model based on the participants' uploaded photos and a prompt. Subject to OpenAI's usage policies and these Terms, you receive a personal, non-exclusive, non-transferable, royalty-free license to download, save, and share the recap image for your personal, non-commercial use. The likeness rights of any individual depicted remain with that individual; you may not exploit the recap image in a way that would violate someone's right of publicity.
5.3 Our content
The Jiya app, brand, design, and underlying technology (excluding Your Content) are owned by Jiya and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices for personal, non-commercial purposes.
5.4 Feedback
If you send us feedback or suggestions, you grant us an unrestricted, perpetual, royalty-free license to use them without obligation.
6. Apple Health data
Jiya reads activity data (steps, walking + running distance, active energy, workouts) from Apple Health on your device with your permission. Aggregated values for active competitions are submitted to our backend; raw Apple Health samples never leave your device. See the Privacy Policy for details.
You can revoke Jiya's HealthKit access at any time in iOS Settings → Privacy & Security → Health → Jiya.
You agree not to upload to or submit through Jiya any health data subject to special legal protections (e.g., HIPAA-covered information beyond the categories listed above) other than what HealthKit naturally provides.
7. Subscriptions and payments
Jiya is currently free to use. If we introduce paid features, additional terms specific to those features will apply. Apple's standard App Store rules govern any in-app purchases.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF METRICS.
Jiya is not a medical device. Activity readings, competition outcomes, and AI recap images are for entertainment and motivation only. Do not rely on Jiya for medical, fitness, or safety decisions. Consult a qualified healthcare professional before starting any new physical activity.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or that defects will be corrected.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT WILL JIYA OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Jiya and its affiliates from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services in violation of these Terms or applicable law,
- Your Content,
- Your violation of any third-party right (including intellectual property, privacy, or right of publicity).
11. Termination
You may stop using the Services at any time. You can delete your account in-app under Settings → Account → Delete account, which permanently removes your profile, photos, and competition participations from our backend (subject to the back-up retention windows in the Privacy Policy).
We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or if continued operation would expose us or others to legal, security, or operational risk.
Sections 5, 8, 9, 10, 12, 13, 14, and any other provisions that by their nature should survive termination, will survive.
12. Apple App Store additional terms
To the extent the Services are accessed through the Apple App Store, the following additional terms apply:
- These Terms are an agreement between you and Jiya, not Apple. Apple is not responsible for the Services or their content.
- Apple has no obligation to furnish maintenance or support for the Services.
- If the Services fail to conform to any applicable warranty, you may notify Apple, and Apple will refund any fees paid for the Services. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any product-liability, intellectual-property, or other claims you or any third party may have related to the Services.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or the Services is the state and federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
If you reside in a jurisdiction (such as the EEA or UK) that grants you the right to bring claims in your local courts, this section does not deprive you of that right.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
15. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any additional terms presented in-app, constitute the entire agreement between you and Jiya regarding the Services.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale.
- Notices. We may give notice via in-app message or to the email address associated with your account.
